2008 House Bill 6232

Revise nonpublic marriage rules

Introduced in the House

June 10, 2008

Introduced by Rep. Dudley Spade (D-57)

To revise the conditions under which a nonpublic marriage may be disclosed. Currently, a court can release records of the marriage only if it affects another persons’ interest in property, or if the two spouses agree. The bill would allow disclosure if one of the spouses has died and the surviving spouse requests it, as long as there was no divorce.
