2020 House Bill 5928

Impose "ex-post facto" virus coverage mandate on business loss insurers

Introduced in the House

May 25, 2020

Introduced by Rep. Robert Wittenberg (D-27)

To retroactively mandate that business-interruption insurance policies that were in effect on Jan. 1, 2020 must cover losses caused by the coronavirus epidemic and government-ordered lockdowns. Insurers would nevertheless be prohibited from increasing policy prices until six months after that coronavirus state of emergency is lifted, and must cover virus-related losses even if the policy specifically excludes losses caused by a virus. The bill is cosponsored by most of the House Democratic caucus.
